Will I Have To Go To Trial After My Crash?
“Will I have to go to trial?” is a question we get pretty regularly as well. The answer is, I don’t know. We are going to treat every case as if it could go to trial. That means we’re going to put the necessary resources into it, whether that means hiring experts, investigators, and taking depositions. We don’t know whether a particular case is going to need to go to trial, but we always act like it will.
Having said that, probably I’m kind of giving you some estimates here, about 80% of cases settle even before filing a lawsuit. And of the 20% where we do file a lawsuit, probably 90% of those settle. But the ones that are left over are the ones where neither side can agree on whether there’s liability or how much the damages are. That’s what makes this interesting, because whenever you get two or three lawyers together, you’re going to have three or four different opinions. And because of those different opinions, sometimes a case does end up going to trial.
