Know Your Rights: West Virginia Home Improvement Consumer Protection
If you’re planning home improvements in West Virginia, it’s crucial to understand your legal protections under state law. The West Virginia Consumer Credit and Protection Act provides important safeguards when hiring contractors.
Your Right to a Written Contract
Every home improvement contract must be in writing and include a clear description of the work, the total price with financing terms, an approximate completion date, the contractor’s contact information, and all warranties. Never sign a contract with blank spaces—contractors must fill in all terms before you sign.
Protection from Deceptive Practices
Contractors cannot lie about your home needing repairs, claim you’ve been “specially selected” for discounts, offer fake “model home” or “leftover materials” pricing, or misrepresent the quality of materials. They also cannot pretend to be government inspectors or hide delivery and installation costs.
Three-Day Cancellation Right
For door-to-door sales, you have a three-day right to cancel. You can cancel until midnight of the third business day after signing by simply mailing written notice. The contractor must return all your money within 10 days and cannot keep any deposits or down payments.
What Contractors Must Do
Contractors must complete work as described in the contract, meet agreed completion dates (unless delayed by events beyond their control), and get your written permission before changing plans or specifications. They cannot disclaim warranties of merchantability or fitness for purpose.
If Your Rights Are Violated
Document everything with contracts, receipts, and photos. Send written notice to the contractor about problems. File a complaint with the West Virginia Attorney General’s Consumer Protection Division. You may also have the right to sue for damages and attorney’s fees.
