Mortgage servicing errors are hidden in ordinary-looking documents. Under West Virginia consumer protection law, each false statement can be a separate violation that is worth discussing with a lawyer.

What laws protect homeowners against predatory mortgage lenders in West Virginia?

Every false statement is a separate violation.

The West Virginia Consumer Credit and Protection Act prohibits false or misleading representations in collecting a debt (including the numbers on your monthly mortgage statement) and prohibits unfair or unconscionable means of collection. The penalty per violation is currently up to $1,400 adjusted for inflation. A servicer that sends a wrong statement every month commits a new violation every month.

The servicer’s excuses don’t matter.

In 2026, the federal Fourth Circuit confirmed in a case about misapplied prepayments and false periodic statements that these claims are strict liability: the homeowner does not have to prove the servicer acted in bad faith or intended to deceive. These are not valid defenses: “our system did it,” “our vendor’s data was wrong,” and “everybody does it this way.”

Escrow money is held for one job.

When a servicer takes your money each month for the specific purpose of paying your taxes and insurance, it takes on a duty to actually do it. West Virginia courts have recognized that the escrow relationship carries obligations beyond the fine print of the loan. Breaching that trust can support significant damages beyond the dollars mishandled, including damages for the aggravation, inconvenience, and distress these failures cause.

The servicer can be ordered to pay your attorney fees.

West Virginia’s consumer statute is fee-shifting. That means when a homeowner wins, the court can make the servicer pay the costs of the litigation, including reasonable attorney fees. That is how a homeowner with a few thousand dollars of out-of-pocket losses can hold a national servicer fully accountable.
