The law in West Virginia, and many other states, is that alcohol serving establishments like bars, night clubs, and restaurants can be held responsible for serving alcohol to a patron who is visibly intoxicated. If a patron is drunk, the bar cannot keep serving alcohol to that person. The reason that a bar can be held responsible for serving someone who is already visibly intoxicated is obvious:  that intoxicated patron is going to get behind the wheel, drive drunk, and endanger anybody who is driving along our roadways.
